PERSONAL DATA PROTECTION AND PROCESSING NOTICE

(Law No. 6698 – KVKK)

This Information Notice has been prepared by AVC GLOBAL Car Rental, acting as the Data Controller, in accordance with the Turkish Personal Data Protection Law No. 6698 (“KVKK”), for the purpose of informing you about the processing of your personal data.

1. Identity of the Data Controller

Pursuant to KVKK, your personal data are processed by AVC GLOBAL Car Rental, as the data controller, within the scope explained below and in compliance with applicable legislation.

2. Processed Personal Data

Within the scope of the service relationship, the personal data that may be processed by us are limited to the following:

  • Identity Information: Name, surname, Turkish ID number / passport details

  • Contact Information: Telephone number, e-mail address, address

  • Contract and Transaction Information: Reservation, rental agreement, invoice, payment and transaction records

  • Vehicle Usage and Damage Information: Vehicle delivery and return records, damage reports, accident reports

  • Financial Information: Payment method, authorization/deposit details

  • Visual Records: Vehicle delivery/return photos, security camera recordings (if any)

  • Legal Transaction Information: Records related to requests, complaints, lawsuits and enforcement proceedings

3. Purposes of Processing Personal Data

Your personal data are processed for the following purposes:

  • Providing car rental services and establishing/performing contracts

  • Managing reservation, delivery and return processes

  • Carrying out payment, invoicing and accounting procedures

  • Managing damage, accident, insurance and legal processes

  • Monitoring customer satisfaction, requests and complaints

  • Fulfilling legal obligations arising from legislation

  • Providing information to authorized public institutions and organizations

4. Legal Grounds for Processing Personal Data

Your personal data are processed in accordance with Articles 5 and 6 of KVKK, based on the following legal grounds:

  • Explicitly stipulated by law

  • Directly related to the establishment or performance of a contract

  • Necessity for the data controller to fulfill its legal obligations

  • Necessity for the establishment, exercise or protection of a right

  • Legitimate interests of the data controller, provided that fundamental rights and freedoms are not harmed

5. Transfer of Personal Data

Your personal data may be transferred, limited to the purposes stated above, to:

  • Insurance companies

  • Authorized public institutions and organizations

  • Third parties providing legal, financial consultancy and audit services

  • Reservation and payment infrastructure providers

in accordance with Articles 8 and 9 of KVKK.

6. Methods of Collecting Personal Data

Your personal data are collected through:

  • Website, call center, e-mail

  • Reservation platforms

  • Rental agreements, delivery and return forms

  • Camera and digital recording systems

by automatic or non-automatic means.

7. Retention Period of Personal Data

Your personal data are retained for the periods stipulated by relevant legislation or for as long as required by the purpose of processing, and upon expiry of such periods, they are deleted, destroyed or anonymized in accordance with the legislation.

8. Your Rights under KVKK

Pursuant to Article 11 of KVKK, you have the right to:

  • Learn whether your personal data are processed

  • Request information if your personal data have been processed

  • Learn the purpose of processing and whether data are used in accordance with that purpose

  • Know the third parties to whom personal data are transferred domestically or abroad

  • Request correction of incomplete or inaccurate personal data

  • Request deletion or destruction of personal data in accordance with the law

  • Request notification of such operations to third parties

  • Object to the occurrence of a result against you by analysis of data exclusively through automated systems

  • Request compensation for damages arising from unlawful processing of personal data

9. Application Method

You may submit your requests within the scope of KVKK to AVC GLOBAL Car Rental in writing or through other methods determined by the Personal Data Protection Board. Applications will be concluded free of charge within the legal time limits.

EXPLICIT CONSENT STATEMENT

This Explicit Consent Statement has been prepared pursuant to the Personal Data Protection Law No. 6698 (“KVKK”) within the scope of services provided by AVC GLOBAL Car Rental.

I hereby declare that I have read and understood the Personal Data Protection and Processing Information Notice, and that I freely give my explicit consent to:

  • The processing of my identity, contact, contract, payment, vehicle usage/damage and legal transaction data,

  • For the purposes of providing car rental services, establishing and performing the contract, carrying out payment and accounting processes, managing damage/accident and insurance procedures, ensuring customer satisfaction and fulfilling legal obligations,

  • The sharing of such data with insurance companies, authorized public institutions and third parties from whom services are obtained.

SHORT KVKK CLAUSE FOR CAR RENTAL AGREEMENT

The Lessee acknowledges that, within the scope of the Personal Data Protection Law No. 6698, they have been informed about the processing of their personal data by AVC GLOBAL Car Rental for the purposes of providing car rental services, establishing and performing the contract, managing payment, damage/accident, insurance and legal processes, and that the necessary explicit consent has been obtained for the sharing of such data with authorized institutions and organizations and third-party service providers where required.
